Force majeure - a circumstance, the occurrence of which could not be prevented by the party responsible for the performance of an obligation, and which is the reason for the non-performance of the latter (for example, war, natural disaster, etc.).

I. Activities in tourism

Types of tourism- internal, entry and exit:

- inbound tourism - travel around the country of persons permanently residing in other countries;
- outbound tourism - travel of persons permanently residing in one country to another country.

International tourism includes inbound and outbound tourism;
- national tourism consists of domestic and outbound tourism;
- tourism within the country is divided into inbound and domestic tourism.

Tourist- a citizen visiting the country (or place) of temporary residence for certain purposes, without engaging in paid activities in the host country and spending at least one overnight stay in this country.

According to international standards, the period of stay cannot exceed 12 months in a row, according to national standards - 6 months. A tourist, as a consumer, is a client of a tour operator or travel agent.

excursionist- a citizen visiting the country (place) of temporary residence in order to get acquainted with its tourist resources without providing accommodation services, for a period of not more than 24 hours. The excursionist, as a consumer, is a client of the excursion bureau.

Purposes of the trip (visit) according to international standards include:

Leisure activities, recreation and recreation;
- visiting relatives and friends;
- business and professional purposes, as well as incentive trips, education and research activities;
- treatment;
- participation in religious events, pilgrimages;
- other purposes, including purchases made during the trip. The main goal is the purpose of the trip (visit), without which the trip cannot take place.

Amateur tourism- a kind of tourism, most of which is sports and recreational activities, travel organized by tourists on their own using active modes of movement in accordance with applicable regulations. As a rule, participants in such trips set themselves the goal of obtaining sports categories and titles in tourism.

Tourist resources- natural, historical, socio-cultural and other objects in the country (place) of temporary residence, capable of satisfying the spiritual needs of tourists and sightseers, contributing to the restoration and development of their spiritual and physical strength. Tourist resources also include specially protected natural areas (SPNA), as well as medical and recreational areas and resorts.

tourism industry- a set of hotels and other accommodation facilities, means of transport, entertainment and trade, catering facilities, educational, business and other purposes, organizations engaged in tour operator and travel agency activities, as well as organizations providing excursion services and services of guide-interpreters, other services, necessary for organizing and making trips (trips).

Tourist infrastructure- a set of means of communication (roads, access roads, stations, airports, marinas, etc.), communications (water, electricity and gas networks, heating, sewerage, communications, etc.), tourist resources, tourist display facilities , accommodation and food facilities, trade facilities, household and medical services, sports facilities, as well as other facilities necessary for the provision and development of the tourism industry.

Tourist product (package of tourist services)- a complex tourist service previously organized by the tour operator, including at least two services: transportation of a tourist to the country (place) of temporary stay and accommodation; sold or offered for sale at a single lump-sum price. In this case, the period of provision of services exceeds 24 hours or includes an overnight stay. The package may also include other tourist services related to planning, organizing and conducting a trip (trip). The most common types of tours (service packages):

Inclusive tour (package tour) - a standard trip with a choice according to the catalogs of tour operators;
- individual tour (journey) - a trip specially developed by the tour operator at the request of the client;

Types of products, services of tourism and hotel industry are presented in the All-Russian Classifier of Economic Activities, Products and Services (OKDP), as well as in the All-Russian Classifier of Services to the Population (OKUN).

Tourism product promotion- a set of measures, including direct advertising, participation in tourist exhibitions, fairs, publication of specialized catalogs, booklets, organization of information trips and other activities aimed at the implementation of the tourist product.

Tour operator (tour organizer)- a legal entity or an individual entrepreneur, acting on the basis of a license for tour operator activity, carrying out planning and organization of a trip (trip), promotion of a package of tourist services necessary for a trip, its wholesale and retail purchase and sale, as well as the provision of other tourist services related to travel (trip).

Travel agent- a legal entity or an individual entrepreneur operating on the basis of a license as a natural agent and promoting a package of tourist services necessary for making a trip (trip), offered on a contractual basis by a tour operator, as well as retailing a package of services to a consumer (tourist), including, according to OKDP, also booking services, issuing travel documents for traveling to foreign countries, as well as booking tickets for international carriers.

Tour agency- a legal entity or an individual entrepreneur carrying out excursion activities in accordance with the established procedure, including planning, organizing, promoting and implementing a comprehensive excursion service, including conducting an excursion, as well as providing other services related to the excursion.

Excursion- visiting museums, exhibitions, other places of tourist interest for the purpose of acquaintance, short-term trips (walks) for educational, sports or other purposes on a collective or individual basis.

Tour guide (guide, guide-interpreter)- an individual who has the appropriate professional education and training, who accompanies tourists when they visit places of tourist interest and provides information necessary for tourists in their native language.

Hotel (collective accommodation facility, hotel enterprise)- a legal entity or an individual entrepreneur that has, on the basis of ownership, lease terms or other legal grounds, a property complex (real estate) under a single management (management), with at least ten rooms, and intended to provide citizens with the services of hotels and similar places residence. According to the regulatory documents of the Russian Federation, hotels, including tourist ones, are part of hotel enterprises, which also include motels, campsites, hostels for visitors and other accommodation facilities.

Specialized accommodation facilities- sanatorium-resort (treatment-and-prophylactic) organizations, organizations of recreation and tourism. Among them are sanatoriums and boarding houses with treatment, sanatoriums, rest houses, boarding houses, bases and other recreation organizations, tourist bases.

Carrier- a legal entity or an individual entrepreneur that owns, leases or otherwise legally the right to a passenger vehicle (land, water or air) and carries out regular or charter transportation of tourists and their luggage on a commercial basis.

Air carrier (air carrier)- an operator that has a license to carry out air transportation of passengers, baggage, cargo, mail and carries out regular or charter transportation of tourists and their baggage on a commercial basis.

Tourist formalities- procedures related to the observance by tourists crossing the state border of certain conditions, rules and requirements established by the state authorities of the country of departure and stay. Formalities are divided into groups: passports and visas; currency control and currency exchange control; customs regulations and medical formalities.

Tourist activity- activities of legal entities or individual entrepreneurs engaged in tour operator and travel agency activities, activities in planning and organizing holidays in clubs with accommodation (leisure clubs), including the sale of rights to club holidays, as well as other activities in planning, organizing, promoting and selling trips and travel.

Hospitality activities- activities of legal entities and individual entrepreneurs who have or are vested in the established manner with property rights to any collective accommodation facility at their direct disposal and management, to provide accommodation and service services to citizens, as well as other activities for the organization and provision of hotel services, including their implementation.

Excursion activity- activities of legal entities and individuals who, in accordance with the established procedure, have the rights to organize visits by citizens of tourist resources in the country (place) of temporary stay and their implementation, as well as other activities that do not include overnight stays at the place of stay and cover a period of stay of no more than 24 hours .

License- a special permit to carry out a specific type of activity subject to obligatory compliance with licensing requirements and conditions, issued by the licensing authority to a legal entity or individual entrepreneur. A license may be annulled by a court decision on the basis of an application from the licensing authority.

Simultaneously with filing an application with the court, the licensing authority has the right to suspend the issued license for a period until the court decision comes into force.

Licensed type of activity- the type of activity for which a license is required on the territory of the Russian Federation. In tourism, licensed activities include: tour operator and travel agency activities, activities for the sale of rights to club holidays.

License requirements and conditions- a set of requirements and conditions established by the regulations on licensing specific types of activities, the fulfillment of which by the licensee is mandatory.

Licensee- a legal entity or an individual entrepreneur who has a license to carry out a specific type of activity.

II. Tourist services and maintenance

tourist service- the result of direct interaction between the service provider and its consumer (tourist), as well as the service provider's own activities to meet the consumer's needs in organizing a trip (travel) and its implementation and other related needs. According to the functional purpose, a tourist service can be material (accommodation, meals, transport) and socio-cultural (excursions and other similar events).

material services- services that ensure the restoration (change, preservation) of consumer properties of products or the manufacture of new products by order of citizens (tourists), as well as the transportation of goods and people, the creation of conditions for consumption. In particular, material services may include household, repair or manufacturing, housing and communal services, catering services, transport, etc.

Social and cultural services- services that ensure the maintenance and restoration of physical health, the spiritual development of the individual, and the improvement of professional skills. In particular, this type of service may include medical services, cultural, tourism, educational services, etc.

Order for a tourist service- a preliminary agreement between the consumer and the service provider, which determines the legal, economic and technical relations of the parties.

Description of tourist service- information about the main characteristics of the tourist service, conditions and cost of service.

Tourist service consumer- a citizen (tourist, excursionist) who intends to order or purchase, or ordering, acquiring or using tourist goods, works, services solely for personal needs, not related to making a profit.

Tourist service provider- a legal entity or an individual entrepreneur providing services to a consumer.

Service- activities of the performer in direct contact with the consumer of the service.

Quality of tourist service- a set of properties of tourist services and service processes to meet the conditional or expected needs of tourists, characterized by the quality of services and culture of service.

Quality of tourist service- a set of characteristics of a tourist service that determine its ability to meet the established or implied needs of the tourist.

Service certification- activities to confirm the compliance of services with the requirements established in the standard. Certification of tourist services is divided into mandatory and voluntary.

Mandatory certification of services- certification confirming the safety of services provided by legal entities and individual entrepreneurs.

Voluntary certification- certification of the quality of services provided is carried out at the initiative of legal entities and individual entrepreneurs on the basis of an agreement between the applicant and the certification body.

Lack of service- a separate non-compliance of the service with the mandatory requirements of the standards, the terms of the contract, as well as information provided by the contractor or seller of the service.

Significant disadvantage- a defect that makes it impossible or unacceptable to use the product (work, service) in accordance with its intended purpose.

Frankfurt Travel Price Reduction Table- a document that determines the rate (in percent) of reducing the cost of the service, depending on the shortcomings in its provision noted by the tourist.

Claims to the quality of the tourist product- an official statement of the tourist about shortcomings and violations in the provision of services (violations of the contract on tourist services), sent in writing to the tour operator or travel agent within 20 days from the date of expiration of the contract. Claims to the contract in accordance with the law are subject to consideration (satisfaction) within 10 days.

III. Contractual relations in tourism. Implemented services. Marketing. Catalogs. Rates. Payment

Tourist Service Agreement- an agreement that binds the consumer of the tourist service (tourist) with the tour operator or travel agent that implements the package of services.

The tourist service agreement is concluded in writing and contains the essential terms of the agreement, including reliable information about the package of services being sold, the retail price and the payment procedure, determines the mutual rights and obligations of the parties when organizing and conducting a trip (travel).

Contract of agency- type of contractual relationship in entrepreneurial activity between the service provider and the seller (tour operator and travel agent). Under an agency agreement, one party (attorney) undertakes to perform certain legal actions on behalf and at the expense of the other party (principal). The rights and obligations under a transaction made by an attorney arise directly from the principal, while the principal is obliged to pay a fee to the attorney, and the attorney is obliged to fulfill the assignment given to him in accordance with the instructions.

Commission agreement- a type of contractual relationship in which one party (commission agent) undertakes, on behalf of the other party (principal), for a fee, to make one or more transactions on its own behalf, but at the expense of the principal. Under a transaction made by a commission agent with a third party, he acquires the rights and becomes obligated to the commission agent.

Agency contract- a type of contractual relationship in entrepreneurial activity, according to which one party (agent) undertakes, for a fee, to perform legal and other actions on behalf of the other party (principal) on its own behalf and at the expense of the principal, or on behalf and at the expense of the principal:

A) in a transaction made by an agent with a third party on its own behalf and at the expense of the principal, the agent acquires rights and becomes obligated to the agent, although the principal was named in the transaction or entered into direct relations with the third party to execute the transaction;
b) in a transaction made by an agent with a third party on behalf of and at the expense of the principal, the rights and obligations arise directly from the principal. In tourism activities, a tour operator acts as a principal, and a travel agent acts as an agent.

Both tour operator and travel agency activities are licensed.

tourist voucher- a written emphasis of the offer of the tour operator or travel agent for the sale of a package of services, which is an integral part of the contract for tourist services, as well as a document of primary accounting for the activities of the tour operator or travel agent. Voucher - a form of strict accountability of the tour operator, serves as confirmation of the fact of the conclusion of the contract for tourist services and its payment.

Voucher - travel voucher- a document, an order of the tour operator to its counterparty (receiving party) to provide the tourist with the necessary tourist services in accordance with the concluded agreement with a guarantee of payment in the prescribed manner. The voucher contains a complete and specific list of services paid by the tourist that must be provided to him. Based on the voucher, the settlement of mutual settlements between the receiving and sending parties is carried out. The form of the voucher is determined by the same parties. The voucher establishes the right of the tourist to the services included in the tour package and confirms the fact of their provision.

Guide side- a legal entity or an individual entrepreneur who organizes a trip (travel) to the country (place) of temporary residence and sends his clients (tourists) there under an agreement with a counterparty.

The host- a legal entity or an individual entrepreneur, a counterparty that accepts tourists who have arrived in the country (place) of temporary residence. The content of the service provided by the host is determined by the voucher issued by the sending party.

Information of the seller provided by him to the tourist, - reliable information about the organizer of the trip (trip) and the seller, the availability of relevant licenses and certificates of conformity, the tourist formalities necessary for making the trip (trip) and the timing of their execution, about the receiving party; information about the full and specific content of the proposed service package, its cost and payment procedure, penalties and the procedure for filing complaints about the content and quality of service, as well as about the travel itinerary, stay program, security information, as well as other information included in the essential conditions tourist service contracts. The information provided must comply with applicable regulations.

Trip Cancellation- refusal in writing of a tourist, tour operator or travel agent from fulfilling obligations under a contract for tourist services.

Tourist travel itinerary- the path of the tourist during the journey, indicated by a list of the names of all geographical points and places successively visited by him during the journey, indicating the types of intra-route transport used by the tourist when moving between stops or stays. The starting and ending points of the route are the starting and ending points of the journey.

Route start- the place where the first tourist service is provided to the tourist on the route specified in the tourist service contract.

End of route- the place where the last tourist service is provided to the tourist on the route specified in the tourist service contract.

Tourist travel program (service program, stay)- a plan of successive events indicating the dates and times of stay at the stops on the route, at the hotel, visits to places of tourist interest in order to inspect them (excursions), meals, and also move along the route using the in-route vehicles indicated in the program.

Rules for the provision of hotel services- a regulatory document that establishes the amount of information communicated to the tourist about hotel services, the procedure for registering hotel accommodation (concluding contractual relations for booking and providing services, including their payment); the procedure for the provision of services (including services at no additional charge), as well as the responsibility of the contractor and consumer for the provision of services.

International Hotel Rules- a regulatory document developed by the International Hotel Association (IHA), which defines the principles of the relationship between the consumer of the hotel service (tourist) and the hotel, their mutual rights and obligations arising from the accommodation agreement.

Code of relations between hotels and tour operators- an international regulatory document, which is a hotel convention on the fundamental principles of the relationship between tour operators and hotels acting as counterparties, when concluding international hotel contracts for the accommodation of tourists.

Group of tourists- a group of people traveling together, arriving and departing at the same time, under the same conditions (standard package of services), which is a separate unit for the travel agent and the hotel. For a group of tourists, hotel services (accommodation and meals) are provided on preferential terms at special prices, and an invoice for the entire amount is issued one per group. According to international standards, a group is 15 people, but 7-10 people can also be considered a group.

Individual tourists- tourists traveling on an individually organized program of stay, and, as a rule, do not use group discounts and benefits.

Basic hotel services- the list and scope of services usually (standardly) provided to the tourist by a collective accommodation facility and paid by the tourist at the conclusion of the contract (accommodation, meals, etc.). The services provided by the hotel are usually listed in the catalogs of this accommodation facility.

Additional services- the list and volume of services that exceed the purchased basic services and are paid additionally by tourists, as a rule, at the place of their consumption.

hotel mission statement- a declarative document about the main goal of the hotel.

Hotel category- classification grouping, characterized by a certain set of requirements; classification of hotels by category, based on a set of requirements for buildings, material and technical equipment of hotels, the range and quality of services provided, and the level of service. Categories are marked with * (star). The number of stars increases in accordance with the increase in the level of service quality, the comfort of the premises and the building itself.

In Russia, hotels are classified into five categories, motels into four. In international practice, other (except stars) category symbols are also used - crowns, rhombuses, rosettes, shields, etc., used by national associations and hotel prices (for example, Best Western, AA Star Rating, AA Country Houses, AA Rosette (in England); Mobil Travel Guide, FFF Tour Book (USA, Canada and Central America).

The classification of the hotel can be developed in relation to the categories of visitors (tourists). In some cases, a hotel may have its own classification, developed by a major tourist operator or a tourist association. So, the Association of British Travel Agencies in its catalogs offers its own classification:

"1 star"- budget hotels located in the central part of the city, having a minimum of amenities of a fairly good quality;
"2 stars"- tourist class hotels with a restaurant and a bar;
"3 stars"- middle-class hotels with a fairly high level of service;
"4 stars"- first class hotels with a very high quality of accommodation and an excellent level of service;
"5 stars"- hotels of the highest category with a level of extra-class service.

In the tourist catalog "Mobil Travel Guide" hotels are divided as follows:

"1 star"- above average;
"2 stars"- very good;
"3 stars"- excellent;
"4 stars"- recommended for a special trip;
"5 stars"- one of the best in the country.

There are many reasons for the lack of a "single world classification of hotels", including the incompatibility of hotels by type (resort, seaside, motel, etc.), location (city center, outskirts, countryside, etc.) and a number of other climatic, geographic, social and other factors. Because of this, most of the developed regional hotel classification systems are advisory, indicative. International hotel chains set their own requirements, higher than the national standards.

Types of hotel accommodation- are determined by a place or a room consisting of one or more places suitable for living in a hotel, including:

Place (bed) - an area with a bed intended for one person (B);

Tour operator catalog (route catalog)- the official information and reference publication of the tour operator, containing a detailed description of the standard tourist product offered by the tour operator for retail sale, including a description of the direction (region) of the visit and the route, its excursion possibilities, the characteristics of the accommodation facilities and the services offered, the rules for the retail sale of the tourist product. The tour operator catalog, in the event that it contains the essential terms of the contract for tourist services, has the character of a public offer. The tour operator is responsible for the accuracy of the information contained in its catalogue. Depending on the completeness of the information, the catalog can be official (company), advertising, general or special.

The essential terms of the contract for tourist services include:

Information about the tour operator, travel agent (retailer), including information about the license, legal and actual addresses, bank details;
- information about the tourist (buyer); a full description of the tourist services (tourist product) offered for sale, including the name and category of the hotel, type of accommodation, food and excursion services, stay program, travel itinerary, information leaflet, safety conditions, as well as a detailed description of the services offered related to the trip;
- date and time of the beginning and end of the trip, the number of overnight stays;
- the procedure for meeting, seeing off and accompanying tourists in the country (place) of stay;
- the retail price of the tourist product (services) and the procedure for its payment;
- the minimum number of tourists in the group, the period for informing tourists that the trip will not take place due to a shortage of the group, the conditions and terms for the return of funds paid by the tourist for the tourist product;
- rights, obligations and responsibilities of the parties in organizing and making a trip;
- conditions for changing and terminating the contract, the procedure for settling claims and indemnifying losses;
- the procedure and terms for the presentation of claims by the tourist to the seller for non-fulfillment of the terms of the contract.

Confidential Tour Operator Directory- the official information and reference publication of the tour operator, containing a detailed description of the tour product offered by the tour operator for small wholesale sales to travel agents included in its agent network, and containing information about various kinds of discounts, conditions for booking trips, etc.

Hotel catalog- an official information and reference publication, as a rule, of a tour operator, containing a list and types of counterparty hotels, as well as their formalized description, including addresses, phone numbers and booking systems, a list of services provided by the hotel, etc. The hotel catalogs may indicate the current rates (“Worldvide Guide to the Hotels and Travel Services”, prepared by the tour operator UTS) and not indicated (“Best Hotels of Russia, CIS Countries and Baltic States”, prepared by the Academservice Corporation and known as the “Best Eastern Hotels” marketing chain catalog ”, which has a price application containing various kinds of tariffs). Hotel catalogs can also be issued by hotel chains. As a rule, such catalogs contain the current rates and periods of their validity (for example, "Best Western", which unites 4000 hotels in 82 countries of the world). Finally, catalogs can also be issued by associations of hotels (clubs) according to other principles (for example, "Italy Hotel Club”, consisting of 25 hotels (three and four stars) for business, leisure and relaxation purposes, as well as the well-known catalog of timeshare clubs affiliated with the international exchange company RCI - “RCI Leisure World”, which contains information on more than 3500 leisure clubs in Europe, America and Africa).

Catalog of specialized accommodation facilities- an official information and reference publication containing a slightly formalized description of sanatoriums, sanatoriums, treatment centers and other specialized accommodation facilities in Russia and abroad, as well as the services provided by them (including the treatment of diseases, health services, etc. .). As a rule, such catalogs do not indicate categories of accommodation facilities and prices for services rendered (for example, catalogs: NTK Turkurortservis, RATA - "Time to relax in Russia", the Profturgaz sanatorium and resort association, "Children's, youth and family holidays in Russia , Crimea and abroad" and a number of others).

Passport of the accommodation facility- a declarative document containing an accurate description of the location, material and technical base and the list of services provided to the client in the accommodation facility.

Agency (confidential) rates- prices for hotel services offered for sale to a travel agent and expressed as percentage discounts from published rates.

Corporate rates- prices for hotel services offered to collective customers who do not carry out tour operator and travel agency activities and are expressed numerically in the form of percentage discounts from published rates.

Tour Operator Tariffs- prices for hotel services offered for sale to the tour operator and expressed numerically in the price set by the hotel, which does not include the tour operator's trade markup.

Group rates- Net-rates for accommodating groups of tourists with the same program of stay. Net prices are formed from the officially published price with a group discount, as a rule, without commission.

Upgrade- provision of accommodation services (rooms), with an increase in the category without charging an additional fee from the tourist.

Price period- the period of time during which all tariffs remain unchanged. Usually the price period coincides with the seasons of tourist activity.

Seasonal price plan- the totality of all price periods that form the year or seasons when the accommodation facility operates.

High season- the period of the greatest active activity in tourism, the most popular time of the year for trips (travel); the period of the highest tariffs for tourist services. The high season may not coincide with the seasons. In some countries, it cannot be less than 3 months.

low season- the least popular time for trips (travel), as a rule, the period of maximum discounts.

Rooms- the total number of rooms in the hotel enterprise.

One-time capacity- the total number of beds (beds, permanent beds) in the hotel enterprise or specialized accommodation facility.

Provision of overnight stays (bed-days) by hotel enterprises- Used number of permanent and temporary seats, including reservations. It is determined by the register of residents.

Hotel fund utilization rate- the number of overnight stays provided, divided by the product of the one-time capacity and the number of days in a year.

Room capacity- the total number of room-days per year in the hotel enterprise.

Fixed quota- a quota with the assignment of certain rooms of the hotel stock to a specific tour operator (travel agent).

Irrevocable quota- a set of obligations of the tour operator and the accommodation facility, in which the accommodation facility transfers to the tour operator the right to implement the quota for the entire period of the contract; at the same time, the tour operator pays the full cost of the quota, regardless of the actual number of travel agents accommodated, and the accommodation facility undertakes to provide the full range of services specified in the contract, without the right to stop the sale.

Return quota (on allotment)- transfer by the accommodation facility to the tour operator of the right to sell within a certain period of time (quota period) a quota for accommodation of tourists - clients of the tour operator.

Sale of accommodation services on request (on reguest)- means that after each application of the client, a request from the tour operator is sent to the accommodation facility. Confirmation or refusal of the application must be sent to the tour operator within 24 hours.

Free sale of accommodation services (free sale)- granting by the accommodation facility to its partners (tour operators, travel agents, etc.) the right to independently confirm their clients the reservation of places in the accommodation facility, while notifying the latter of the reservation made.

release date- the day the tour operator (travel agent) returns unsold (non-reserved) rooms to the accommodation facility, which is separated from the actual date by the duration of the release period.

Release period (release period)- period of time during which numbers are released from the quota.

Sale stop period- the period of time for which the unrealized balance of the tour operator's (travel agent's) quota is withdrawn by the accommodation facility.

Remaining quota- quota numbers not sold by the tour operator (travel agent) by the time the sale was announced. In this case, the tour operator is obliged to book all sold and unbooked rooms within 24 hours from the moment the sale is announced, and the accommodation facility is obliged to unconditionally confirm the reservation.

Direct Booking- booking without intermediaries.

Non-guaranteed booking- a type of "direct" booking, in which the accommodation facility provides the client with a room before 18.00 on the day of arrival, after which the reservation is canceled without penalty.

Guaranteed Booking- a type of "direct" booking, in which the accommodation facility provides the client with a room before the check-out time of the day following the day of the scheduled arrival. In this case, the application of penalties depends on the form of payment for the order. In case of late cancellation of the trip or no-show, penalties are usually equal to the cost of one day of stay (overnight stay).

Booking hotel services on contractual terms- a type of long-term cooperation and partnerships with tour operators, travel agents, corporate clients based on the conclusion of mutually beneficial agreements related to such concepts as "sale on request" and "free sale".

Order (reservation)- a one-time act of booking certain services for certain periods for certain tourists.

List with order conditions- a list containing the last names, first names and gender of the persons included in the group; information about the distribution of rooms and services to be provided to the group; information officially required by the Ministry of the Interior of the host country.

Confirmation of an order- the official response of the accommodation facility about the consent to accept and fulfill the order.

Order Cancellation- refusal of the tour operator (travel agent) from all or part of the order. Cancellation is divided into no-show or late cancellation.

no show- the actual non-arrival of the tourist at the accommodation facility on the scheduled day of arrival or cancellation of the order made less than 24 hours before the date of arrival specified in the order.

Cancellation deadlines- the number of calendar days before the date of arrival, under which cancellations are considered timely. If the deadlines are reduced, cancellations are considered late.

Cancellation penalty- the amount paid by the tour operator to the accommodation facility in case of violation of the cancellation deadlines (no-show or late cancellation).

Arrival day- the date of arrival of the tourist in the accommodation facility.

Number provision time (chick in time)- check-in time of the tourist in the room (local) on the day of arrival.

Departure day- date of departure of the tourist from the accommodation facility.

Number release time (chick out time)- time (local), no later than which the tourist must vacate the room on the day of departure.

Order payment procedure- the procedure for settlements made by the tour operator with the accommodation facility, which includes a full or partial advance payment (prepayment); at the same time, the final payment for the services provided is made upon the provision of these services.

Full (or partial) advance payment- the payment procedure, in which the tour operator transfers to the account of the accommodation facility an advance payment for services that will be provided to customers by the tour operator after receiving the advance payment; the advance payment may be the full (full advance) or incomplete (partial advance) cost of the services to be rendered. A partial advance may take the form of a deposit (deposit) or security deposit. In international practice, a deposit is a contractual compensation that is non-refundable in the event of termination of the contract due to the fault of the party that made the deposit, but which is refundable in a certain amount in the event of termination of the contract through the fault of the party that received the deposit.

Payment upon rendering of services- the payment procedure, in which the tour operator, within a certain period after confirmation by the accommodation facility of the fact of the provision of services, pays in full for the services rendered. At the same time, the fact of the provision of services is confirmed by the presented means of placing an account for the tour operator, a tourist voucher and other documents specified in the contract.

IV. Club vacation

Leisure Club- accommodation club - a commercial or non-commercial organization created for the purpose of organizing and providing recreation, recreation, sports, familiarization with tourist resources, promotion and implementation of the rights to club recreation and having an appropriate license. The terms for which a recreation club can be created are established by its founders and indicated in the charter. After the expiration of the specified terms, membership in the club is terminated.

Leisure club founder- a legal entity or an individual entrepreneur exercising the rights of ownership transferred to him (possession, use, disposal) for accommodation facilities intended exclusively for recreation, by creating, registering, managing a recreation club, promoting it to the market and organizing sales of rights to club recreation. The owner of accommodation facilities can also be the founder of a recreation club.

Leisure club charter- a set of rules and regulations that establish and regulate the structure of the club, the procedure for its activities and the relationship between the club and its members. The charter of the recreation club is developed by its founders and registered in the manner prescribed by law. Changes to the charter can only be made by decision of the general meeting of club members. The charter of the club determines the order of use of accommodation facilities, the procedure for paying entrance and annual membership fees, as well as termination of membership in the club (refusal to the owners of the rights to club holidays in providing accommodation) in case of non-payment of membership fees, up to exclusion from club members after appropriate notification.

Leisure club member- an individual or legal entity that has entered into an agreement for a club holiday, paid an entrance fee for membership in the club, entered in the register of members of the holiday club and has the rights and obligations determined by the charter of the club.

Leisure Club Membership Register- an official document of the recreation club, in which all buyers who have fully paid for the services and received a club member certificate are recorded.

Multiclub- voluntary association of several recreation clubs, all members of which are guaranteed access to accommodation facilities in any of these clubs on the terms determined by the charter of the multi-club.

Leisure club accommodation facilities- a hotel or other collective or individual accommodation facility used by the club to accommodate its members. Accommodation facilities are divided into rooms and apartments (accommodation blocks).

Leisure club accommodation owner- a legal entity or an individual entrepreneur that owns the rights of ownership to collective or individual accommodation facilities intended for organizing and providing recreation, or disposes of them under a long-term (at least 50 years) lease agreement.

Placement block type- the size of the apartment room and the quality of amenities in it, provided to the member of the club in accommodation facilities.

Leisure club accommodation facilities apartments- the minimum element for booking the services of recreation club accommodation facilities, which are classified based on the size of the apartments, the availability of bedrooms, kitchens and bathrooms, as well as their equipment. The sizes of the apartments depend on the indicators of maximum capacity and comfort and are divided into studio, one-bedroom, two-bedroom, etc.

Maximum occupancy of the apartment- the maximum number of people that can be accommodated in one apartment.

Maximum comfort- the number of persons living in the apartment in the most favorable conditions, based on the accommodation of two adults in each bedroom.

Club vacation- a type of recreation in accommodation facilities owned by the recreation club, which are part of the tourist complex, which is under the economic jurisdiction of the club and equipped to provide various services on the terms and within the time limits determined by the contract for club recreation and the charter of the club.

rest interval- length of stay in the accommodation facilities of the selected holiday club, measured in nights or nights, multiple of one week. There are “fixed” (fixed) and “floating” (floating) weeks, as well as a club holiday scheme “once every two years”.

holiday season- a certain period of the year during which the consumer (tourist) owns the interval of rest. The following holiday seasons are distinguished: high (most visited), low (least visited) and off-season.

Club vacation in split time mode- (a timeshare vacation with accommodation of a certain type (apartment or room) in a certain club during a certain period of each year, for a duration of at least one week annually (or on a biennial basis) that occurs either on one or the same week of the year in order (“fixed week”), or determined by the club administration for each calendar year (“floating week”).

Club vacation in real time- holidays, the duration and type of accommodation block of which depend on the number of points, credit points or other units of measurement accepted in the holiday club that belong to the member of the holiday club, allowing their owner to independently determine what time of the year, during what period of the year and in what from the accommodation facilities available to the club, he can spend his holidays.

The right to club rest- a type of tourist product that includes a long-term (at least 3 years) guaranteed right to rest in recreation club accommodation facilities and to receive services, confirmed by a club holiday agreement and a certificate of a holiday club member. After the expiration of these terms, membership in the club is terminated.

Sale of rights to club rest- sale to the buyer by a recreation club (seller) on the basis of a valid license of the right to accommodation and recreation in this club (in real time or split time), confirmed by an agreement for club recreation and a personal certificate of a club member (primary sale). The activity of selling the rights to a club holiday also includes the activity of buying out the rights to a club holiday by legal entities or individual entrepreneurs for the purpose of their resale and / or commercial use (secondary sale). Secondary sale can be organized on the principle of commission trading.

Sales organizer- an individual entrepreneur or a legal entity that promotes the right to a club holiday in the market in any way not prohibited by law, with the exception of its sale.

Seller of the right to club rest- an individual entrepreneur or a legal entity that, within the framework of entrepreneurial activities, sells the right to club holidays (primary sale) on the basis of a license. The primary sale is carried out either by the holiday club itself or by another seller acting on behalf and on behalf of the latter. The activity of selling the rights to a club holiday also includes the activity of buying out the rights to a club holiday on the basis of a license by legal entities or individual entrepreneurs for the purpose of resale and / or commercial use.

Buyer of the right to a club holiday- an individual or legal entity that has expressed a desire to purchase or is acquiring the services of recreation clubs for purposes not related to making a profit.

Club vacation contract- an agreement concluded between the seller and the buyer, on the basis of which the buyer, after paying the seller a certain amount of the contract, acquires the right to rest in a particular club in a certain season and the interval of rest in the apartment (room) chosen by him.

"cooling off" period- the time during which the buyer of the rights to a club holiday can refuse to conclude an agreement without explaining the reasons and without compensating the seller for any losses.

Leisure club membership certificate- a personal document established by the recreation club, confirming membership in the relevant club and a long-term guaranteed right to rest in it.

Exchange program- description of the algorithm for solving the equivalent replacement of rest (season, interval, placement block) in one club for an equivalent rest in other clubs included in the exchange program.

exchange company- an organization created for the purpose of offering clients-members of a holiday club the opportunity to exchange their holiday for an equivalent holiday in any of the company's affiliated holiday clubs.

Management Company- a company (organization) for the management of a recreation club, responsible for its management, maintenance in it and carrying out its activities on the basis of an agreement with a recreation club.

For some countries, especially EU countries, non-departure insurance is mandatory (when buying a full package) and cannot be canceled. Its cost is not included in the package price and is paid separately.
  • unconditional franchise- set amount minimum expenses, which is deducted from the insurance indemnity in all cases.
  • conditional franchise- if the amount of damage (expenses incurred) does not exceed this amount, the insurance indemnity is not paid. If the amount of damage exceeds this amount, then the insurance indemnity is paid in full, without deductions (as in the case of an unconditional deductible).
